LOGISTIFIE LTD - Logistifie Driver App Terms of Use
This mobile application (the Logistifie Driver “App”) is made available by Logistifie Ltd, a company limited by guarantee and registered in England and Wales with number 12596401 and with a registered address of 73 Oaklands Grove London W12 0JE. The mobile application (APP) is designed for use on iOS and Android smart phones, it is primarily intended to enable its Subscriber’s verified drivers/owners/fleet/sub-contractors (partner) and sub-contractor’s drivers to undertake jobs which are allocated according to their availability and geographic location.
These Terms and Conditions of use apply to the use of the Logistifie’s Subscriber’s verified drivers/owners/fleet/sub-contractors (partner) and sub-contractor’s drivers that enables users to register their details and once verified these registered users can login, notify the subscriber that they are available and after assignment can undertake jobs for their company. By installing the APP, you agree to be bound by these terms and conditions of use which should be read and understood prior to installation, and which may be updated from time to time. You may not modify, copy, publish, sell, transfer the rights to or otherwise use this APP for any purpose other than to facilitate your activities with Logistifie’s subscriber. You, the user of the APP, confirm your acceptance of these APP terms and conditions. If you do not agree to these APP Terms, you must immediately uninstall the APP and discontinue its use.
You are reminded that under the Road traffic act use of mobile phones while driving a moving vehicle is prohibited. On December 1, 2003, "The Road Vehicles (Construction and Use) (Amendment) (No. 4) Regulations 2003", came into force, this prohibits drivers from using a hand- held mobile phone, or similar device, while driving. It also made it an offence to "cause or permit" a driver to use a hand-held mobile phone while driving, are therefore advised that under no circumstances should you use this APP whilst driving, its use should only be when your vehicle is parked and stationary with the engine turned off. Failure to abide by these regulations will make you liable for prosecution by the authorities which could result in your losing your driving licence and receiving a substantial fine. There are ‘hands free’ kits on the market and you are strongly advised to secure one for your vehicle.
You agree not to use the App in any way that is unlawful, illegal, or unauthorised.
To uninstall the APP, please use the application manager provided with your device or consult your device manual for reference.
The APP is free to download for drivers as it comes under a subscription for the company who tend to use Logistifie to manage their business. The registered user is responsible for any and all charges incurred with the mobile provider and/or internet service provider as a result of using the APP.
TAll trademarks, copyright, database rights and other intellectual property of any nature in the APP together with the underlying software code are owned by Logistifie Ltd. Users do not acquire any rights and/or interest in the APP through use.
The APP is available on the Apple iOS and Android operating systems. Software requirements are Apple iOS devices running iOS 21.1 and Android OS devices running Android OS 5.0 to 11 in the English language. The APP is designed for use on smart phones. Logistifie accepts no responsibility for unavailability of the APP, any difficulty incurred in downloading, installing or accessing information or any communication system failure which may result in the APP being unavailable. Logistifie may occasionally need to take the service used by the APP offline in order to improve the service or to perform routine maintenance. During these times, the APP will not be able to retrieve any information. Other than the aforementioned. Logistifie will not be responsible for any support or maintenance of the APP.
The personal data information that a subscriber (the company who you may have registered) collects necessary information to registered you as a driver (fleet/owner, subcontractor, or driver of a subcontractor) enters all details in Logistifie server which is securely stored at Fasthosts Internet Ltd in UK. Information that you provide to us when applying for registration through subscribers includes- Your name, gender, date of birth, physical address, contact information such as phone number and email address, your all driving documents and all details and documents of your vehicle which you will provide to our subscriber details and any other relevant personal and financial Information that you provide to our subscriber. Downloading the Logistifie Driver app you are agreeing to receive OTP varication to your registered mobile number in order to Login to the app.
You agree that the information provided by you will be uploaded in Logistifie System to create your driver profile.
Logistifie treats personal information lawfully and correctly. To this end Logistifie fully endorses and adheres to the principles of data protection as set out in the Data Protection Act 1988 and the new General Data Protection Regulation which will replace the Data Protection Act and is scheduled to come into force in May 2018. Logistifie will retain your personal data, your usage and location data from the APP which Logistifie shall use to improve our services and you hereby agree to such use and your personal and location data that is recorded by this APP is available for the registered user to view upon request.
In no event will Logistifie be liable for any direct or indirect loss or damage arising out of your use or access to the APP including but not limited to any damage or alteration to your equipment, including but not limited to mobile telephones, smart phones or other handheld devices as a result of installation of the APP.
These Terms of Use are governed and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over disputes between you and Logistifie arising out of your use of the Logistifie Driver app.
Logistifie may vary these terms from time to time, such variations will be posted on Logistifie website https://logistifie.com and such variations shall take effect one month from posting. You should check the website regularly as you will be deemed to have accepted such variations if you continue to use the APP after they have been posted on the website.
Logistifie may cancel or terminate your use of the APP at any time for any period without notice. On termination for any reason, you will cease use of the APP.
